Grandparents Rights in Utah 801-676-5506 Free Consultation

You’ve probably heard about the Grandparents visitation rights statute in the State of Utah.  It’s Utah Code 30-5-2.  However, you may not yet know that the Utah Supreme Court case of Jones v. Jones has ruled that Utah Code Section 30-5-2 is unconstitutional.  This makes getting grandparents rights a lot more difficult that it was in the past.

Watch this video for more information:

Grandparents used to be able to file a petition with the District Court and get visitation rights.  Not anymore.  I explain in this short video a few of the exceptions that would apply to allow you to get visitation rights or even custody rights of the grandchildren.

It’s important to let you know at this junction that each factual scenario is different.  Our law office has been able to get grandparent visitation rights in the past.  We’ve even been able to get custody rights of grandkids under certain circumstances as well.  It’s important that you speak with a qualified lawyer to discuss your specific situation because no two situations are the same.

One of the things we can do is speak over the phone or in person and you can tell me about the facts of your case and I can give you my candid opinion of whether or not it is even worth your time and effort to try to get grandparent visitation or custody rights.

Give my office a call 801-676-5506.  If I am unavailable, please schedule a telephone appointment of an in person meeting.  Our office has free initial consultations.

Free Consultation Child Support Lawyer in Utah 801-676-5506

In this blog post I answer several Frequently Asked Questions about child support in the State of Utah.

I also do it in a video – watch the video below. You can also read on if you prefer reading…

Question: Do I have to pay child support each month? Answer: yes, if there is a court order or an administrative order, you do. If you are the parent of a child and you and the other parent are separated, the parent who has fewer overnights a month should be paying an amount of child support each month to the other parent. If you have an order in place, you need to follow that order until or unless it is changed. Give me a call if you have questions about this.

Question: What are the consequences if I don’t pay child support? Answer: The child support arrears can become a money judgment against you. Child support cannot be discharged in a bankruptcy case, so you are stuck with it forever. Additionally, in Utah, it is crime not to pay child support. I have seen cases where the State has prosecuted those who don’t pay their child support. This is serious so don’t play around with it. Make sure you keep written receipts and proof that you have paid in just in case someone later says you didn’t. You want to be able to prove you are innocent and have paid all of your child support each month.

Question: Can I get child support lowered? Yes you can. If a child support order is already in place, we need to show that you have had a drop in income each month and we can have child support re-calculated. You really should meet with a good attorney to make sure you have calculated child support correctly. I’ve seen a guy in the last few months who wanted to lower child support and we discovered that his support payments would increase each month if he filed with the court — needless to say, we didn’t bother to file because he would have ended up paying more! Don’t make this mistake.

Question: How do I get child support lowered? You do this by filing a petition to modify your divorce decree (if you were divorced). If you were never married and hence, never divorced, then you likely have a paternity order or a custody order. The process then is filing a Petition to modify child support or a petition to modify the paternity order.

These things can become complicated. The best thing to do is to speak with me and we can discuss your case in detail.

How Long Does a Divorce Take in Utah

I’m sure you’ve asked the question how long is this legal separation going to take? It is different in every state – you may have heard of the ninety day waiting period.

There have been a few times that you can get the 3 month waiting period waived.

You would have to file a motion to waive the 90 day waiting period.

You need to set forth for the judge a really good reason to shorten the waiting period.

In this episode you’ll find that cases can go on for many years.

The case file you see in the video has been going on for over a decade!

No kidding!

Watch this video to hear the story:

When someone doesn’t do what they are ordered to do in a decree of divorce then you have to go back to the judge and enforce the judgment.

That’s what happened here.

Utah Divorce Attorney Answers the Question: Can I get remarried during the divorce process?

http://www.Guardian-Law.com

Top reviewed Divorce Attorney in North Salt Lake UT Answers Your Questions

Can a couple get married while going through divorce?

Of course the answer is no.

You see, while you are going through divorce, you are still married to the person you are getting divorced from.

It’s a really good idea not to co-habitate during the divorce process because if your ex is seeking fault in the divorce proceeding you could be required to pay your ex-spouse’s attorney fees and costs.

Watch this video that attorney Michael Anderson put together that explains the answer to this question and even gives a quick tip to help you:

Additionally, this is called bigamy in Utah and is currently a 3rd degree felony! yikes… you really don’t want criminal problems along with your divorce problems.

Make sure and get advice from a licensed attorney in the state of Utah who is an elite divorce lawyer otherwise you could be hurting yourself.

We are Utah divorce attorneys.

This is designed to answer questions that we received about Utah divorce cases.

How to determine Child Support in Utah

One of the questions I get asked all the time is about child support.  Child support can be tricky depending on several factors; however, the essence of Utah child support can be calculated rather easily.  You go to the ORS website and click on the link for child support calculator.  You’ll be taken to the webpage that you see in this video.  Once you are there, you fill out each of the questions.  I explain all of this in the video.

You need to put in the mother and father’s name.  You need to put in how many children are subject to the support case.  You need to then put in the amount of gross income that both the father and mother make.  Remember, gross income is the amount of money you make in a month before taxes are taken out.  Then you put in the custody arrangement (how many overnights, etc.).  Finally, you put in other information about prior awards and other kids, etc.

Once you fill out the form, you click on the submit button and are taken to a PDF in your internet browser that has done the child support calculation for you.  That is the child support worksheet amount that should be followed.  Keep in mind that in order to change the child support obligation, you are going to have to show good cause or a really good reason as to why you are making the change.  The judge also has to approve it.

Also, you should know that courts don’t let you not have a child support award.  In other words – you have to put a child support calculation into your custody order or decree.  The judge won’t sign it unless there is child support being paid.  The court’s job is to protect the best interests of the child.  One of the ways courts do that in Utah is by making sure that there is money for the kids being paid each month.  Keep that in mind for your custody or divorce case.

I hope this information has been helpful to you.  If you have other questions or concerns about child support in your Utah custody or divorce case, call me 801-676-7308 – your family law attorney in Utah.
