Question: Do I have to pay child support each month? Answer: yes, if there is a court order or an administrative order, you do. If you are the parent of a child and you and the other parent are separated, the parent who has fewer overnights a month should be paying an amount of child support each month to the other parent. If you have an order in place, you need to follow that order until or unless it is changed. Give me a call if you have questions about this.

Question: What are the consequences if I don’t pay child support? Answer: The child support arrears can become a money judgment against you. Child support cannot be discharged in a bankruptcy case, so you are stuck with it forever. Additionally, in Utah, it is crime not to pay child support. I have seen cases where the State has prosecuted those who don’t pay their child support. This is serious so don’t play around with it. Make sure you keep written receipts and proof that you have paid in just in case someone later says you didn’t. You want to be able to prove you are innocent and have paid all of your child support each month.

Question: Can I get child support lowered? Yes you can. If a child support order is already in place, we need to show that you have had a drop in income each month and we can have child support re-calculated. You really should meet with a good attorney to make sure you have calculated child support correctly. I’ve seen a guy in the last few months who wanted to lower child support and we discovered that his support payments would increase each month if he filed with the court — needless to say, we didn’t bother to file because he would have ended up paying more! Don’t make this mistake.

Question: How do I get child support lowered? You do this by filing a petition to modify your divorce decree (if you were divorced). If you were never married and hence, never divorced, then you likely have a paternity order or a custody order. The process then is filing a Petition to modify child support or a petition to modify the paternity order.
